COLMES: From Cleveland, Ohio, Democratic Congressman James Traficant. OK, Congressman, we've been billboarding this idea that you've wanted to come on HANNITY AND COLMES tonight. There's something you want to tell us. The floor is yours. REP. JAMES TRAFICANT (D), OHIO: Sean and Alan, let me tell you this. The reason I've come on your show is on my last appearance I was flooded, literally, with calls and letters all around the country and your show must Before I get into my statement, I just listened to the diatribe you had with your previous guests...

COLMES: Diatribe?

TRAFICANT: I think we should not look at the religious background or the ethnic heritage of the candidate. I think we should look at the competency and Senator Lieberman is very well-respected. He puts balance to that ticket and I'll tell you something, this is going to be a real, a real horse race here.

COLMES: You might even vote Democratic now, right, congressman?

TRAFICANT: Well, no, I'm going to vote for whom I think is best for America.

COLMES: I see.

TRAFICANT: But now let me get down into what I'm here to talk about.

COLMES: Go ahead.

TRAFICANT: After my last appearance on your show, and I said that I am prepared to do what I have to do to fight, I think we have a Justice Department that's out of control. I believe they have selective prosecution. I believe that they target political opponents. And I love the United States of America but I said right here and I love the elected officials, but I'm beginning to hate the bureaucratic government that exists in this government of fear. Well, subsequent to that appearance, I have received several affidavits and here's what these affidavits allege, and I have done some cursory investigation on it and will follow up further myself on a limited budget. What I received was that Janet Reno was first appointed to Dade County State Attorney, they call them state attorneys there, as a favor and a thank you to the mob. No. 1. No. 2, she is a lesbian and I really don't care about anybody's sexual preference...

COLMES: Now why do you say that? That's not fair. What's that have to do with anything?

TRAFICANT: Hear me. Hear me. This is an affidavit I'm talking about.

COLMES: You don't know that for a fact.

TRAFICANT: This is an affidavit I'm speaking to and I want you to listen to me because I don't really care about anybody's sexual preference.

COLMES: Well, why bring it up?

TRAFICANT: But because-because it's in the affidavit and listen to the salient points, Alan. I'm not talking about Democrat and Republican and I want you to set Democrat aside tonight and set Republican aside tonight. Janet Reno had a relationship with a call girl who was associated with organized crime figures and they have videotapes of this woman. Now hear me. Also, he had five police officers to stop Janet Reno for substance abuse, namely DUI, under the influence, willing to testify, never testified. Now here's the point I'm making. Listen very carefully. I will be submitting FOIA requests because I believe Janet Reno, in her issue, national security issue of China, she did so because of her blackmailability. I want to know why and how long it took for the FBI to investigate, if they gave this information to the Senate, if the Senate knew about the compromises they had from with outside the government, they knew about her past history of alcoholism, association with call girls and they did interview several of the affiants (ph) that have, in fact, given me these affidavits. HANNITY: Hey...

TRAFICANT: Now, hold on. HANNITY: Hey, Congressman, hold on one second.

TRAFICANT: Hold up. HANNITY: Let me just, let me ask a couple, let's clarify...

TRAFICANT: Go ahead. HANNITY: You have just declared war tonight on Janet Reno. You've made some very...

TRAFICANT: Yes, I have. HANNITY: Hang on. You've made some very severe allegations.

TRAFICANT: Yes, I have. HANNITY: You say you have affidavits.

TRAFICANT: Yes. HANNITY: Who are these affidavits from?

TRAFICANT: These affidavits wish to remain anonymous but they will testify in an open court or a Congressional hearing of appropriate nature or jurisdiction. HANNITY: You are saying she has associated and that people can testify...

TRAFICANT: Yes. HANNITY: ... with evidence...

TRAFICANT: Yes. HANNITY: ... that she was connected to the mob?

TRAFICANT: Yes. That's exactly what I'm saying, and that because of the fact, and I'm looking into this. I'm not throwing any darts at the President at this point or anybody. I want to know if the President got that information. I want to know the time span from when the FBI went down and interviewed these affiants on these particular allegations and how long it took for her to be confirmed. Janet Reno was one of the exceptions. She, they waived that 72 hour period from the hearing to the confirmation.

COLMES: All right, Congressman, we've got to take a quick break...

TRAFICANT: In this love fest-hear me.

COLMES: We're going to take...

TRAFICANT: In a love fest, she became the attorney general and I'm accusing the attorney general...

COLMES: All right, Congressman, we're going to have-we're going to go to our...

TRAFICANT: ... of treason right here.

COLMES: We're going to go to our separate corners for a moment. We'll pick this up in just a second with Congressman Traficant on the other (COMMERCIAL BREAK) HANNITY: Welcome back to HANNITY AND COLMES. I'm Sean Hannity and we continue with Ohio Congressman James Traficant. Congressman, you've made some incredible allegations here tonight. You've declared war against the attorney general. You've accused her of being connected to the mob. You've accused her of being blackmailed in a lesbian relationship...

TRAFICANT: Blackmailability. HANNITY: ... and you say...

TRAFICANT: Comprised by that blackmailability. HANNITY: Blackmailability...

TRAFICANT: And I am saying... HANNITY: You say you have affidavits.

TRAFICANT: ... I am saying that she has betrayed our nation... HANNITY: She's committed treason.

TRAFICANT: ... because she set herself above the nation's security by was the only Democrat to come out and ask for her resignation when she had taken that stand, I have been targeted. So it may be relevant in my trial. There's going to be a proper jurisdictional hearing at some point in America not about Democrats, Republicans, Gephardt or Armey, it's about our national security. HANNITY: All right, let me, in the short time that we have, you've accused her of treason as we were going to the last break.

TRAFICANT: Go ahead. HANNITY: You have these affidavits you say will prove your case here. What are you hoping to accomplish or to do by coming out with these allegations? What are you going to, are you going to bring evidence forward...

TRAFICANT: I'm going to attempt to get all the evidence I possibly can. Now, you have four presidential candidates here. You've got Gore, you've got Bush, you've got Buchanan and you've got Nader, this should be thrown right into the mix. Look, we talked about Monica Lewinsky and spent $100 million on a sexual affair and the poor woman's life has been wrecked because of it, while we have a red dragon looking down our throat with missiles pointed at us and we didn't have a high school debate on this issue and when it came to the Congress, Chairman Burton was discredited. They went after Henry Hyde. HANNITY: How specific...

TRAFICANT: They did a great job. HANNITY: Give me the specifics...

TRAFICANT: We've had no hearing in America, Alan. HANNITY: I agree. I think we should. No, we should.

TRAFICANT: No hearing in America on our national security. HANNITY: Give me the connection, sir, to accuse somebody of treason, give me the connection to treason. Tie it together for the audience.

TRAFICANT: Very simple, someone who would aid and abet possibly our greatest enemy and threat that we had without even allowing an investigation into it. Now look, that business...

COLMES: How did she do that?

TRAFICANT: Hear me. That business that you may not be reappointed to a second term, don't run that on the sheriff because she could have gone ahead and nodded and got that reappointment and said for the betterment of

COLMES: Congressman... counsel.

COLMES: Congressman, you don't like the fact...

TRAFICANT: And she stayed away from it.

COLMES: Hold on a second. Hold on a second.

TRAFICANT: (unintelligible) Alan?

COLMES: You don't like the fact that she didn't appoint an-yes. are other people in Justice who felt that she should not appoint an

TRAFICANT: Oh, let me tell you...

COLMES: Then-wait, wait. Hold on. Let me just...

TRAFICANT: No, hear me out.

COLMES: Hold on. I want to ask you a question.

TRAFICANT: The Justice Department is a damage control entity.

COLMES: Then you...

TRAFICANT: First of all, hear me, the underlings are investigating her for her nomination. She was on a fast track to be nominated. That FBI is scared to death of that Justice Department. gives you the right to come and hurl mud at her?

TRAFICANT: No, I don't agree with her...

COLMES: Do you have any...

TRAFICANT: No, no, no.

COLMES: And you won't even say where you heard that information.

TRAFICANT: Hear me. Hear me.

COLMES: You have an obligation to tell us...

TRAFICANT: It will come forward...

COLMES: ... what's your sources.

TRAFICANT: ... at the right time and in the proper form.

COLMES: What's your source?

TRAFICANT: And I'm going to make sure it'll come forth in a trial.

COLMES: Why won't you tell us your source now?

TRAFICANT: Well, because...

COLMES: If you're going to come on and...

TRAFICANT: It's not appropriate now.

COLMES: You're going to come on and hurl these allegations...

TRAFICANT: It's not appropriate to this...

COLMES: ... it's appropriate to tell where you get them.

TRAFICANT: I'm not making allegations. I am repeating the allegations that were made to me in sworn affidavits...

COLMES: Do you want her to sue you?

TRAFICANT: ... with credible people who are willing to testify in an open courtroom.

COLMES: Do you want her to sue you? HANNITY: Are you doing...

TRAFICANT: Sue me. If she sues me, we have a trial. Bring it on, Janet Reno.

COLMES: Are you doing this...

TRAFICANT: If she doesn't, I'm going the take it forward and my case is a part of the motive of what they've done. She has betrayed America and I'm accusing her of treason.

COLMES: Isn't your goal here to prevent your own self from being sued and...

TRAFICANT: Not at all. Not at all.

COLMES: ... save yourself in your...

TRAFICANT: Not at all.

COLMES: ... and the allegations against you.

TRAFICANT: Not at all. Had I not have gotten these affidavits, I wouldn't have said a thing. I think somebody in America's got to speak up here. My god, we didn't even have a junior high mock trial on this case. Everybody is afraid to death. Everybody is afraid of the Justice Department. Second of all, I have legislation that would appoint a fair justice agency. I don't believe the FBI should be qualifying the attorney general who's going to be their boss. I think the new fair justice agency director should be doing the investigative background on that particular appointment.

COLMES: All right.

TRAFICANT: We have no check and balance, folks.

COLMES: Congressman...

TRAFICANT: I'm accusing her of treason. Sue me, Janet Reno. Let's get something into court on China.

COLMES: Congressman James Traficant, as always.

TRAFICANT: Thank you.

COLMES: A lively debate. Thank you for being with us tonight and thank you for joining us. We hope you have a great night. We'll be back tomorrow and we'll examine the Vice President's pick for vice president, how will it affect Hillary's Senate run in New York? That's tomorrow night. Thank you for joining us. Have a good night.
